These Terms of Service (“Terms”) govern your access to and use of the Castle website at castle.tech, including its pages, content, and materials (the “Site”). The Site is operated by Castle Technologies Inc. (“Castle,” “we,” or “us”). By accessing or using the Site, you agree to these Terms; if you do not agree, do not use the Site. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization.
The Site is an informational website. Castle’s services and any transaction are provided only under separate written agreements, such as customer agreements, risk disclosures, and trade confirmations (“Transaction Documents”). If these Terms conflict with applicable Transaction Documents, the Transaction Documents control. Nothing on the Site, and no inquiry you submit through it, creates a customer, client, advisory, or brokerage relationship with Castle.
Informational Purposes Only
The Site and its content are provided for general informational purposes only and are intended for professional and organizational audiences at least 18 years old. Nothing on the Site is an offer to sell or a solicitation of an offer to buy any event contract, swap, or other financial instrument, or a recommendation of any transaction or strategy.
The Site does not provide commodity trading, investment, legal, tax, accounting, or insurance advice. No order can be placed, and no transaction can be entered, through the Site. You are solely responsible for your own decisions.
Event Contracts and Risk
Event contracts and other derivatives involve substantial risk and are not appropriate for every business or person. You may lose the entire amount paid or committed to a transaction. Event contracts are not insurance, and no hedge is guaranteed to prevent a loss or achieve a particular result.
The Site may display examples, prices, probabilities, payouts, and performance results that are hypothetical or simulated. Unless identified as actual, they do not represent actual trading, are subject to inherent limitations (including the benefit of hindsight), and are not a representation that any similar results will be achieved.
Castle’s role in any transaction is defined by the applicable Transaction Documents. Exchanges, market makers, data providers, and counterparties are independent of Castle unless expressly stated otherwise. References to a regulated entity do not mean that any regulator has sponsored, approved, or endorsed Castle, the Site, or any transaction.
Inquiries and Submissions
If you contact us through the Site or by email, you agree to provide accurate information. We handle information you submit as described in our Privacy Policy. Please do not send confidential or sensitive information through the Site. Submitting an inquiry does not obligate Castle to respond or to provide any service.
Intellectual Property
Castle and its licensors own the Site and all of its content, software, designs, and trademarks. Castle grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your internal business and informational purposes. All other rights are reserved.
Acceptable Use
You may use the Site only in compliance with applicable law. You may not interfere with or disrupt the Site or its security; scrape, copy, frame, or commercially exploit the Site except as expressly permitted in writing; misrepresent your identity or affiliation; or use the Site to violate another person’s rights.
Third-Party Links
The Site may link to third-party websites and services, including scheduling tools, press coverage, and social media. These links are provided for convenience only, are not endorsements, and are governed by the third party’s own terms. Castle is not responsible for third-party content or services.
Availability and Changes
We do not guarantee that the Site will be uninterrupted, error-free, complete, or current. We may change, suspend, or discontinue any part of the Site, or restrict access to it, at any time without notice.
Disclaimer of Warranties
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, Castle disclaims all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement, and makes no warranty regarding the accuracy, reliability, completeness, or availability of the Site or its content.
Limitation of Liability
To the fullest extent permitted by law, Castle will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, opportunities, goodwill, or data, arising from or relating to the Site or these Terms, and Castle’s total aggregate liability arising from or relating to the Site or these Terms will not exceed $100. These limitations do not apply to Castle’s fraud, willful misconduct, or gross negligence, or to liability that cannot lawfully be excluded or limited.
Indemnification
You will indemnify and hold harmless Castle and its affiliates, officers, directors, employees, and agents from and against third-party claims, losses, liabilities, and reasonable attorneys’ fees arising from your use of the Site in violation of these Terms, applicable law, or another person’s rights.
Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising from or relating to the Site or these Terms must be brought exclusively in the state or federal courts located in New York County, New York, and each party consents to the personal jurisdiction and venue of those courts. TO THE FULLEST EXTENT PERMITTED BY LAW, EACH PARTY KNOWINGLY AND VOLUNTARILY WAIVES ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION ARISING FROM OR RELATING TO THE SITE OR THESE TERMS.
Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on the Site with a revised “Last updated” date, and your use of the Site after they take effect constitutes acceptance of the updated Terms to the extent permitted by applicable law.
General
You may not assign these Terms without Castle’s prior written consent; Castle may assign them to an affiliate or in connection with a corporate transaction. If any provision is unenforceable, it will be modified only as necessary, and the remaining provisions will remain in effect. A waiver must be in writing. These Terms and the Privacy Policy are the entire agreement concerning use of the Site; Transaction Documents govern any services or transactions. Provisions that by their nature should survive do so.
